Ms. Downey - I was a bit surprised when we received your review last week just before Christmas. You were disbursed settlement funds in July 2020. This was the first notice I received of your dissatisfaction. I too was disappointed in you only receiving $3,500. Please recall that the the multiple cars included multiple claimants. The at-fault party had a $30k/$60k policy meaning that the maximum an individual claimant could receive was $30,000 with a total of $60,000 maximum paid to all claimants. The insurance company for the at-fault party is required distribute the funds equitably. Situations such as this often lead to clients receiving less than adequate compensation. I agree that is what happened here. However, sometimes our clients have UIM (underinsured motorist insurance) coverage. Unfortunately, that was not the case with your claim. If you had UIM insurance, I am certain we would have collected you another $30,000 minimum. Also, we would NEVER accept an insurance offer against our client's wishes. The choice to settle or try a case is the client's. We relayed the $18,500 offer and explained that it was the maximum that could be collected from the at-fault party's insurance (for the reasons explained above). I specifically remember telling you that the decision to settle is yours and we will gladly take the case to trial if you would like. I explained that taking the case to trial would almost certainly result in you receiving less money in your pocket. You agreed to settle, then changed your mind, then agreed again to settle. Moreover, I'd like to make sure our numbers match up. You indicated in your review that you received $3,500+. That is true. But I also advanced you $500 from the potential proceeds early on. This means you received over $4,000. Please also recall that I reduced my attorneys fees by over $1,000 and waived over $300 in expenses so I could put more money in your pocket. Additionally, we obtained care for you with multiple chiropractors. When the wreck happened, you were living in Oklahoma. Following the wreck, you stayed with your son in Gainesville. We found and covered chiropractic care for you in Gainesville. Then you moved to Mansfield and we found and covered chiropractic care for you there too. I was in a wreck Oct.15th 2019. I was hit by 3 cars. While they did arrange Chiropractic services for me, my settlement was so low that I could have negotiated it myself. I am in extreme pain every day with no end in sight. In the beginning laura told me that we would go after everyone involved in my wreck. To me that means all 3 cars involved. That is not what happened. What happened is we only went after the person who initiated the wreck who, unfortunately only had liability. This means that even though I was 100% not at fault, I only received a very little portion of the 60,000$ that liability insurance provides. I only talked to my lawyer ( on the phone) when they were ready to settle and he probably wouldn't have talked to me at all except for the fact that when I found out the settlement was going to be a 3 way split I became so angry I couldn't see straight. He assured me that he has tried cases like mine before and there was no way I was going to get more than 3500$. Three thousand dollars and a lifetime of pain. So while I'm sure the 4 star rating for this law firm is accurate for someone else, it is not for me. Do your research people and if your looking for a non aggressive lawyer who just accepts what the insurance company offers then these are the attorneys for you

Ken - I understand that you wanted to settle for more than the amount proposed by the mediator. But as for me allowing the insurance company to trample right over you, I completely disagree. If you're upset with the amount of money you ended up with, that's one thing. Quite frankly, I think you had unreasonable expectations when it came to the value of your case. But to say that I don't fight for my clients is ridiculous. I pride myself on that more than anything. But I also know when it's wise to advise my clients to settle. If you had told me you did not want to settle and preferred to try your case, I would have gladly. The day you picked up your check and posted this review on Facebook is the first time you ever mentioned your disappointment in my representation of you. Accordingly, when I received notice of this review via Facebook, I immediately reached out to you in hopes of discussing. I called and left you a voicemail and followed up with a text. I'm very disappointed in how my case was settled. My attorney, Chris Stoy allowed an insurance company to trample right over me. He really let me down. On a positive note, I enjoyed working with Alma, Christi and Kim Anderson. I know if Kim had been at my mediation I would have been taken care of! I waited a long time for not much of a relief from my accident.
